Missing Exhibitors is a service of Internet Physics, Inc.
Who we are
Missing Exhibitors is a service of Internet Physics, Inc., a Delaware corporation (Delaware file number 10348328). In these terms, "we", "us" and "our" mean Internet Physics, Inc. acting under the name Missing Exhibitors, and "you" means the business that receives our free gap list or places an order with us.
Our services are for businesses only. By placing an order, you confirm that you act for a business and may bind it.
How Missing Exhibitors works
We work by email. When you ask for something that these terms and your order confirmation do not answer, we refer it to the officers of Internet Physics, Inc., and the answer reaches you by email from john@missingexhibitors.com.
The free gap list
The free gap list costs nothing and commits you to nothing. It is not a trial: it never turns into a paid order, and we never ask for payment details to send it. We prepare at most one free gap list for each company, identified by its website domain. We build it only from public sources, as described below, and you may use it as you wish.
The gap list covers your association's next show. It names about 25 companies that exhibit at two or three named peer shows in your industry but are absent from your current or last exhibitor list. For each company it gives the peer show where it exhibits, its booth size where the peer floor plan shows it, and a link to its public contact or marketing page. One paragraph gives how many companies the full gap list holds and our commission term.
We build it only from public exhibitor lists, floor plans and company websites: your association's public exhibitor directory or floor plan for its current or last show, the public websites and exhibitor lists of the peer shows (including the exhibitor lists ConferenceDB publishes), and each company's public website. It needs nothing from you. It cannot show whether your staff have already approached a company.
What we do for paying customers
Net-new exhibitor campaign
One email campaign for one upcoming show, named in your order confirmation. It covers:
- The full gap list for that show, with a named marketing or events contact for each company where public pages show one. Companies with no public contact are skipped.
- Two to three emails per company over six to ten weeks, sent in your association's name from the subdomain you delegate to us, offering your booths and sponsorship packages from your prospectus, in the email template you approve.
- Replies answered from your prospectus. A question your prospectus does not answer is handed to you.
- A weekly email handing over each interested company by name and date, with its question, and a dated lead log of the companies our campaign emails reached.
- A campaign report: emails sent, replies, hand-offs, and introduced companies that later appear on the show's exhibitor list.
- A commission statement for each such company, as "Prices and billing" describes.
Your staff contract with, invoice and take payment from exhibitors as today. The campaign ends on the show's opening day. The campaign sends all its emails within 10 weeks of its first send.
What you give us, and when:
- When you accept the order: your prospectus for the show (booth and sponsorship packages, prices and booking link); your list of the companies that exhibited or sponsored at your shows in the previous two years; and your in-talks list of the companies your staff are already discussing, which you send with it.
- After you accept the order: your IT contact adds, once, the DNS records we supply for the sending subdomain.
- When you accept the order: your approval of the email template, by email reply.
- During the campaign: the contract value and payment date of each company on the lead log that contracts, as your order confirmation states.
Your order confirmation states the full rules for which companies count as net-new, when a company counts as introduced, how contract values are reported, and how a disagreement or an unpaid statement is settled. They are part of your order.
What's not included
- No phone calls or texts to anyone
- No contracts, invoicing or taking payment from exhibitors (the association's staff do this as today)
- No renewal or rebooking of past exhibitors
- No on-site sponsor fulfilment, floor-plan management or prospectus design
- No access to the association's systems beyond the shared prospectus, the past-exhibitor list and the delegated sending subdomain
- No emails to companies on your past-exhibitor or in-talks lists
- No emails to anyone on your opt-out list or ours
Prices and billing
All prices are in US dollars and exclude any sales tax that applies by law. We bill only the events this section names; our own errors, retries and failed checks are never billed. We do not ask for payment details before you accept an order, and we start paid work only after you accept it as described in "How orders are made".
Net-new exhibitor campaign: 20% of the first contract value for the campaign's show of each booth or sponsorship bought and paid for by a company we introduced that did not exhibit or sponsor in the previous two years and was not on the association's in-talks list at acceptance of the order. No up-front fee; nothing is owed otherwise.
A commission becomes billable for a company only when all of these hold: the company is net-new under the lists your order confirmation names; our campaign email to it was delivered and recorded in the lead log; its first contract for the campaign's show (a booth, a booth upgrade or a sponsorship bought together as one order) was signed within the window your order confirmation states; and your association has received payment for that contract. The contract value excludes taxes and pass-through charges such as electrical or freight.
We never bill the gap list, accepting the order, the campaign's emails, replies, hand-offs or reports, a company that is not net-new or was not introduced, a contract your association has not been paid for, later contracts, other shows or renewals, or a company first emailed after you cancel.
Commission is invoiced by a statement sent by email, one statement a month, listing each attributed company, its reported value and the 20% fee. Each fee is due within 30 days after the association receives the exhibitor's payment, paid by bank transfer (ACH or wire) to the account of Internet Physics, Inc. named on the invoice; payment instructions come with the invoice. Your order confirmation states what happens if an invoice is unpaid.
Cancelling an order
You may cancel a campaign at any time by replying CANCEL to any email from us, or by emailing hello@missingexhibitors.com with the word CANCEL. We confirm the cancellation by email, and sending stops within 2 business days. Commission stays due only on companies introduced (emailed) before the cancellation date that then meet every term of your order; nothing else is owed. If you cancel before our first send, nothing is owed.
Guarantees and refunds
Every guarantee we offer, with its conditions, and our refund rule are on our guarantee page at https://missingexhibitors.com/guarantee. A promise that is not on that page or in your order confirmation is not a guarantee we make.
How orders are made
We send you an order confirmation by email from john@missingexhibitors.com. It states what we will do, the price and the guarantee that apply. An order is made when you reply to it with "Yes, I accept". The order confirmation and these terms are our whole agreement for that order; if they differ, the order confirmation applies.
Your responsibilities
You confirm that the information and files you send us are accurate and that you have the right to give them to us for the work you order. You use what we deliver in compliance with the laws that apply to you.
The reply that accepts an order comes from your association's business address, from its executive director or another person authorised to bind it, with that person's name and title. That reply is also your association's written authorisation for us to send the campaign emails in its name, from the subdomain it delegates, using the template it approves.
Each campaign email is sent in the association's name, from a subdomain it delegates to us, and advertises its show; the association is the sender named in the From line. Internet Physics, Inc. sends the emails as the association's service provider and is responsible for each email's form: accurate From and routing headers, a subject line that matches the content, the association's postal address and a working opt-out link in every email, opt-outs honoured before the next send and never later than 10 business days, and the suppression list. The association is responsible for the prospectus facts the emails quote, for supplying its postal address, and for forwarding to us within 2 business days any opt-out it receives directly. Either party's opt-out list applies to every later campaign.
You send us the lists, the prospectus, the template approval and the contract records your order confirmation names, at the times it names. If your association needs its own contract or vendor forms, we answer by email that we accept orders by written reply only; you may attach the order confirmation and your reply to your own records.
Your material and our work
You keep all rights in the material you send us. Once you have paid for an order, what we deliver under it is yours to use and change. We keep the right to reuse our general methods and know-how, but not your material or your deliverables. How we handle personal information is described in our privacy policy at https://missingexhibitors.com/privacy.
Confidentiality
We keep the non-public information you send us confidential, use it only to do your work, and share it only with the kinds of service providers our privacy policy names. This does not cover information that is public or that you have told us we may share.
No promise of results
We promise the work described in your order, not a business result such as replies, meetings, sales or revenue, unless a guarantee on our guarantee page says otherwise. Estimates, examples and benchmarks we share are not promises.
A company on the gap list exhibits elsewhere; we do not promise that it will reply, book a booth or sponsor your show. An interested company handed to you is not a contract, and the number of net-new exhibitors a campaign brings is not promised.
Limitation of liability
Apart from the work described in your order and the guarantees on our guarantee page, we make no other warranties, express or implied. The free gap list is provided as is.
Except for amounts you owe for work delivered, each party's total liability arising out of or relating to these terms or any order is limited to the amount you paid us under the order concerned in the 12 months before the claim arose. Neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, even if told they were possible. Nothing in these terms limits liability that cannot be limited by law.
Ending an order
Either of us may end an order that is not yet finished, by email, if the other seriously breaks these terms and does not fix it within 15 days of being told. You then pay for the work delivered up to that point, and we refund what you paid for work not delivered.
Changes to these terms
We may change these terms by publishing a new version on this page with a new effective date. An order keeps the terms in force when it was made. For a plan that renews automatically, we email you any change at least 30 days before it applies to you, and you may cancel before then.
Governing law and disputes
These terms and every order are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Before either of us starts a legal claim, we try for 30 days to settle the matter by email. A claim that is not settled is brought only in the state or federal courts located in Delaware, and both of us accept their jurisdiction.
General
You may not transfer an order to someone else without our agreement by email. If a court finds part of these terms unenforceable, the rest still applies. Notices under these terms are given by email: ours come from john@missingexhibitors.com, and yours go to hello@missingexhibitors.com.
